Terms and Conditions of Sale
Quotations:
Quotes are valid for 7 days and are subject to stock availability. Orders over £500 will only be processed after acceptance of a quote in writing or by electronic mail, which in turn implies acceptance of the General Terms of Sale of Products (this page). ESP Projects reserves the right to vary the item ordered in the event of non-availability provided there is no substantial alteration in the functionality or cost of the alternative product.
Product Information:
Prices are checked regularly, however, if we find the price has changed significantly when we process your order we will contact you and ask if you wish to proceed. ESP Projects Ltd makes every effort to supply the goods described in the written quotation, but on occasion items supplied may vary slightly due to manufacturer’s alterations; product recalls; part-code changes; and errors in the product descriptions. ESP Projects Ltd will only consider a return in cases of a significant departure of the product from the description given in a written quotation and in all cases where we have been notified within 3 days of supply.
Goods Inappropriate for Need:
Subject to the right of consumers to return goods for refund under The Consumer Protection Regulations 2000, ESP Projects Ltd does not sell products on a trial basis. Clients are strongly advised to familiarise themselves with the product specifications or raise questions based thereon before placing an order. Any failure to identify the appropriate product for the purchasers’ needs – whether of a technical or a presentational nature – lies strictly with the client, and ESP Projects Ltd will not accept goods returned on the basis of said goods being inappropriate for need.
Cancellation:
You have the right to cancel an order which does not contain items personalised or licensed solely to you within 7 working days. If you wish to cancel your order you must do so in writing or by email within 7 working days of receiving the goods. The goods must be unopened and in the original packaging, with all the seals intact. All goods are inspected on arrival and refunds will not be issued if the goods are not in this condition. They must be in a re-saleable condition and must be returned to us at your expense. We will refund the total amount paid for the goods, less any delivery and collection charges, within 30 days of receiving the returned goods. This right does not apply to non-transferable or customised products such as some forms of software licensing.
Faulty or Damaged Goods:
Claims for damaged or faulty goods must be made within three days of receipt. After this date, replacements will not be offered. All goods delivered to UK addresses carry at minimum a 12-month manufacturer’s warranty. Customers who wish to make a warranty claim must comply with the manufacturer’s instructions and warranty procedure. ESP Projects reserves the right to refer you directly to the product manufacturer in such cases. ESP Projects will provide you with the contact information for the relevant manufacturer. The warranty does not apply if the goods have been altered or damaged in any way by the customer or it’s employees or agents, or goods not used in accordance with the manufacturer’s instructions.
Payment:
Payment is due within 28 days of issue of an invoice. Any dispute over an invoice must be raised within 7 days of receipt. Payment must be made by cheque or BACS transfer only. Failure to pay within 28 days will lead to further action being taken against you.
Liability:
ESP Projects Ltd will not be liable for any consequential or indirect damage or loss, however, caused. This includes loss of profits, loss of goodwill, damage to trading relationships and financial loss. ESP Projects is explicitly not liable for failure or errors in third-party services or products even where such services or products have been configured by staff of ESP Projects Ltd. ESP Projects Ltd liability in respect of all other losses shall be limited to the invoiced value of the relevant order. These terms and conditions do not affect your statutory rights. These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and the parties submit to the exclusive jurisdiction of the English and Welsh courts. ESP Projects Ltd reserves the right to change or amend these terms and conditions at any time without prior notice.
